About Us
PluggIn™ is a field retail automation app designed for FMCG companies, sales managers, distributors, manufacturers who have field employees and want to automate their field sales process. With features like GPS-based employee location tracking, order automation, distributor management, beat planning, attendance and leave management, this field retail automation app has a unique market feature where retailers can shop using its marketplace features to increase product sales and distribution at the retail level.Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural. Definitions For the purposes of this Privacy Policy:- “Account” means a unique account created for you to access our Service or parts of our Service.
- “Application” means the software program provided by the Company downloaded by you on any electronic device, named PLUGGIN APP (Field Retail Automation App)
- “Company” (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to PLUGGIN NETWORKS (PTY) LTD.
- “Country” refers to SOUTH AFRICA.
- “Cookies” are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.
- “Device” means any device that can access the Service such as a computer, a cell phone or a digital tablet.
- “Personal Data” is any information that relates to an identified or identifiable individual.
- “Service” refers to the Web & Mobile Application.
- “Service Provider” means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analysing how the Service is used.
- “Usage Data” refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- “you” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Registration and account
You may not register with our marketplace if you are under 18 years of age (by using our marketplace or agreeing to these general terms and conditions you warrant and represent to us that you are at least 18 years of age). If you register for an account with our marketplace you will be asked to provide an email address/user ID and password and you agree to:- keep your password confidential;
- Notify us in writing immediately if you become aware of any disclosure of your password; and
- be responsible for any activity using the service or the marketplace arising out of any failure to keep your password confidential and that you may be held liable for any losses arising out of such a failure.
- Users account shall be used exclusively by the user and user shall not transfer account to any third party. If when authorizing any third party to manage your account on his/her behalf this shall be at your own risk.
- We may suspend or cancel your account and/or edit your account details at any time in our sole discretion and without notice or explanation providing that if we cancel any products or services you have paid for but not received and you have not breached these general terms and conditions we will refund you in respect of the same.

Terms and conditions of sale
Users acknowledge and agree that:- the service and marketplace provides an online location for sellers to sell and retailers to purchase products;
- we shall accept binding sales on behalf of sellers but (PluggIn is not a party to the transaction between the seller and the buyer; and
- a contract for the sale and purchase of a product or products will come into force between the buyer and seller on the marketplace and accordingly you commit to buying or selling the relevant product or products upon the buyer’s confirmation of purchase via the marketplace.
- the price for a product will be as stated in the relevant product listing;
- the price for the product must include all taxes and comply with applicable laws in force from time to time;
- delivery charges packaging charges handling charges administrative charges insurance costs other ancillary costs and charges where applicable will only be payable by the retailer if this is expressly and clearly stated in the product listing; and delivery of digital products may be made electronically;
- products must be of satisfactory quality fit and safe for any purpose specified in and conform in all material respects to the product listing and any other description of the products supplied or made available by the seller to the buyer; and
- In respect of physical products sold the seller warrants that the seller has good title to and is the sole legal and beneficial owner of the products and/or has the right to supply the products pursuant to this agreement and that the products are not subject to any third party rights or restrictions including in respect of third party intellectual property rights and/or any criminal insolvency or tax investigation or proceedings; and in respect of digital products the seller warrants that the seller has the right to supply the digital products to the buyer.
Payments
Solution users and retailers must make payments due under these general terms and conditions in accordance with the Payments Information and Guidelines on the marketplace.Rules about content
In these general terms and conditions “content” means:- all works and materials (including without limitation text graphics images audio material video material audio-visual material scripts software and files) that you submit to us or our marketplace for storage or publication processing by or onward transmission; and
- all communications on the marketplace including product reviews feedback and comments.
- be offensive obscene indecent pornographic lewd suggestive or sexually explicit;
- depict violence in an explicit graphic or gratuitous manner; or
- be blasphemous in breach of racial or religious hatred or discrimination legislation;
- be deceptive fraudulent threatening abusive harassing anti-social menacing hateful discriminatory or inflammatory;
- cause annoyance inconvenience or needless anxiety to any person; or
- constitute spam.
- any copyright moral right database right trademark right design right in passing off or other intellectual property right;
- any right of confidence right of privacy or right under data protection legislation;
- any contractual obligation owed to any person; or
- any court order.
- contacting another user to buy or sell an item listed on the marketplace outside of the marketplace; or
- communicating with a user involved in an active or completed transaction to warn them away from a particular buyer seller or item; or
- contacting another user with the intent to collect any payments.
Personal Data:
While using Our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:- Email address
- First name and last name
- Phone number
- Address, State, Province, ZIP/Postal code, City
- GPS/Location data
- Usage Data
Usage Data:
Usage Data is collected automatically when using the Service. Usage Data may include information such as your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device.Information Collection:
While using Our Application, in order to provide features of Our Application, we may collect, with your prior permission:- Information regarding your location: We use this information to provide the core features of our Service. The information may be uploaded to the Company’s servers and/or a Service Provider’s server or it may be simply stored on your device. You can enable or disable access to this information at any time, through your Device settings.
Use of Personal Data
- The Company may use Personal Data for the following purposes:
- To provide and maintain our Service, including to monitor the usage of our Service.
- To manage your Account: to manage your registration as a user of the Service. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered user.

- For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

Our contracts with these third parties outline the appropriate use and handling of your information and prohibit them from using any of your personal information for purposes unrelated to the product or service they’re providing. Either PluggIn Networks (Pty) Ltd or the other company may offer these products and services. We clearly identify these co-branded products and services. In some cases, we exchange customer usage information to establish and provide ongoing service. By requesting these products or services, users are permitting us to provide their personal and usage information to the other company. We also may share non-identifiable, non-personal aggregate information about our users with third parties, such as advertisers or partners, for marketing and promotional purposes. Our Websites may provide links to third-party sites, such as those of our business partners and online advertisers. These could include other services, promotions or sweepstakes offered by business partners. Because PluggIn™ App does not control the information policies or practices of these third parties, you should review their privacy policies to learn more about how they collect and use personal information. If we sell, merge or transfer any part of our business, part of the sale may include your personal information. If so, you will be asked if you’d like to stop receiving promotional information following any change of control.Retention Personal Data
The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. The Company will also retain Usage Data for internal analysis purposes. Retailers must make payments due under these general terms and conditions in accordance with the Payments Information and Guidelines on the marketplace.Business Transactions
If the Company is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.Law enforcement
Under certain circumstances, the Company may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).Legal requirements
